The new policy centres on two main areas: 0 b* R- V+ z0 U( ]5 f! v) @) W9 Q% g( ^ S/ w! [
Extending the maintenance concession for Tier 4 applicants who arealready in the United Kingdom - this will help to ease the transitionprocess for would-be students. 4 F3 g( R. ^/ }" B, y% f( j% N
Tying Tier 4 students' permission to stay to their sponsors, ifthey make their application on or after 5 October - this willstrengthen Tier 4 and strengthen the United Kingdom border. " m6 b) M6 X- U! fExtending the maintenance concession for Tier 4 applicants who are already in the United Kingdom9 c2 k+ V m9 Z2 p
Tier 4 applicants need to have enough money to cover their coursefees and maintenance. They must normally show that they have held thismoney for a 28-day period ending no more than one month before theirapplication, but until now we have operated a concession allowing themto show only that have the required funds in place on the date whenthey apply. This concession ends on 1 October 2009.; i3 w* D6 o' j8 j0 j( X
: l" p2 w5 z# ]1 v) KHowever, we recognise that many students already in the UnitedKingdom will not have needed to show this money before, so we havedecided to allow a longer transitional period for all Tier 4applications made within the United Kingdom. + S2 @* A8 ~: S+ Z# e+ H0 t# K7 M7 k& a9 G) c. [4 n4 ^( L
Would-be students who make a Tier 4 application from inside theUnited Kingdom before February 2010 will only need to show that theyhave the money needed on the day when they apply. They must stillprovide the correct documents to support their application. ! A# S0 p" M, M, C" n+ X2 f+ u0 i X9 ]2 r$ a
From 1 October 2009, would-be students applying from outside theUnited Kingdom must show that they have held the required money for a28-day period ending no more than one month before the date of theirapplication. # g t3 a" i7 o% j! Y8 I5 Q+ P1 L2 f
Tying Tier 4 students' permission to stay to their sponsors, if they make their application on or after 5 October2 E: `2 z* ~: L9 t7 C$ g
On 5 October 2009, new Tier 4 students' permission to stay in theUnited Kingdom will be 'tied' to the education provider that issponsoring them. This will bring Tier 4 in line with other tiers of thepoints-based system.8 E; R# T% I& S

From 5 October, every new Tier 4 student will find their sponsor'sreference number on the vignette in their passport or on their identitycard for foreign nationals. ( T1 [4 Q! k- o( D- D5 [- C1 _3 B7 E. `' K8 T+ I0 o' V
In future, if a student wants to study with a new Tier 4 sponsorand they made their last application for a Tier 4 visa on or after 5October 2009, they will need to apply for a new Tier 4 visa. They willnot be allowed to begin studying with the new education provider untilthey have received a decision on the outcome of their application - ifthey do so, they will be committing a criminal offence for which theycould be prosecuted or removed from the country.+ w8 T3 d2 g5 r& w" ? h* ~

We have been asked whether students in this situation will be ableto begin studying with the new education provider, at their own risk,before they have received a decision on their application. The UKBorder Agency cannot condone a criminal offence, and therefore cannotadvise students that this is an option for them. We will make everyeffort to ensure that applications from students wishing to changeeducation provider are considered within the published servicestandard, so that they can move to the new education provider asquickly as possible. $ y( [ k. F# j2 T }+ U ^1 n" p5 g8 j J BIf a student wants to study with a new Tier 4 sponsor, and theymade their last application for a Tier 4 visa before 5 October 2009,they will continue to be allowed to change their without making a newTier 4 application. They must, however, seek permission from us tochange their sponsor.
